Your use of the ContextualScience.org website is subject to the terms and conditions below. By registering a user account and using this website, you show your agreement to these terms. If you do not accept these terms, please do not register a user account or use this website. ACBS reserves the right to update this policy without prior notice in order to comply with applicable laws and regulations or to improve the experience of our users.

Site Ownership and Purpose

ContextualScience.org is owned and operated by the Association for Contextual Behavioral Science (ACBS), a non-profit organization dedicated to the advancement of functional contextual cognitive and behavioral science and practice so as to alleviate human suffering and advance human well being.

This site contains copyrighted material the use of which has not always been specifically authorized by the copyright owner. We are making such material available to provide educational information that is related to ACT, RFT, and contextual/behavioral psychology in general. We believe this constitutes a "fair use" of any such copyrighted material as provided for in section 107 of the US Copyright Law. In accordance with Title 17 U.S.C. Section 107, the material on this site is distributed without profit online. (For more information see: http://www.law.cornell.edu/uscode/17/107.shtml). If you wish to use copyrighted material from this site for purposes of your own that go beyond "fair use," you must obtain permission from the copyright owner. Children

Consistent with the Federal Children's Online Privacy Protection Act of 1998 (COPPA), we will never knowingly request personally identifiable information from anyone under the age of 13 without requesting parental consent.

Conduct and Prohibited Uses

You are responsible for, and assume all liability associated with, any material you make available or transmit through ContextualScience.org, whether through web pages, blogs, chat rooms, messages boards or other forums, including liability for claims of infringement, libel and slander. You may not post, transmit through or otherwise make available on or through this website any material that violates or infringes in any way upon the rights of others, that is unlawful, defamatory, obscene, abusive, profane, vulgar, sexually explicit, racist, threatening, hateful or otherwise objectionable or that encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law. Although ACBS does not and cannot review all content posted on or transmitted through this website, it shall be under no obligation to permit any material posted or transmitted to remain on the site, and may remove from, or refuse to display on the site any material that ACBS, in the exercise of its sole discretion, believe violates this agreement. Without limiting the foregoing, you also agree not to transmit, distribute, post, communicate or store information or other material on, to or through this website that:

  • is obscene, defamatory, threatening, harassing, abusive, hateful, slanderous or embarrassing to any other person or entity or in violation of applicable law as determined by ACBS in its sole discretion;
  • infringes upon any intellectual property rights of others or on the privacy or publicity rights of others;
  • is sexually explicit;
  • constitutes advertisements or solicitations of business, surveys, contests, chain letters or pyramid schemes; or
  • contains viruses, Trojan horses, worms, time bombs, or other computer programming routines or engines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data, or information.

You further agree not to:

  • use any incomplete, false, or inaccurate biographical information or other information for purposes of registering as a user of this website;
  • delete or revise any material or other information of any other user of the website;
  • harvest, collect, or send information about others, including email addresses, without their consent;
  • take any action that imposes an unreasonable or disproportionately large load on the website's infrastructure;
  • use any device, software, or routine to interfere or attempt to interfere with the proper working of this website or any activity being conducted on this site;
  • use or attempt to use any engine, software, tool, agent, or other device or mechanism (including without limitation browsers, spiders, robots, avatars, or intelligent agents) to navigate or search the website to harvest or otherwise collect information from the website to be used for any commercial purpose;

ACBS may investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations. ACBS reserves the right (but does not have the obligation) to review postings on this website, to remove any postings, and to terminate your ability to post to this website at any time without notice, in its sole discretion. ACBS also reserves the right to disclose any information necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post, or to remove any information or materials, in whole or in part.

You understand and expressly agree to the following:

Indemnification

Upon a request by ACBS, you agree to indemnify and hold harmless ACBS and its respective affiliates, directors, officers, agents, or other partners and employees from and against all liabilities, claims and expenses, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post, or transmit through this website, your use of the website, your violation of this Agreement, or your violation of any rights of another.

1.2 These Terms of Use and all other terms and conditions related to the use of the website shall be governed by and construed in accordance with the laws of the state of Nevada, United States of America, without regard to its conflict of law provisions. By use of the website or creating a Link, you hereby consent to the exclusive jurisdiction of and venue in the federal and state courts located in the county and state of the principal place of business or primary residence of the website owner, United States of America, for all disputes arising out of or related to the use of the Website, any information contained on or provided through the Website, and the creation and maintenance of a Link, and you waive all defenses to the exclusive jurisdiction of such courts.

1.3 If any provisions of these Terms of Use shall be unlawful, void or for any reason unenforceable, then such provision shall be deemed severed from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.

1.4 These Terms of Use supersede any prior agreements or understandings between you and the Website Owner not incorporated into these Terms of Use. In the event of any inconsistency between these Terms of Use and any future posted Terms of Use, the last posted Terms of Use shall control.

Accessing Contextualscience.com (“Site”) constitutes a use of the Site and an acceptance to our Privacy Policy. Any modifications to this Policy will be made by posting changes on the Site

Protecting your privacy is important to us. You understand and acknowledge that we gather certain types of information from visitors and registered users of our site. This Policy outlines the capture and use of that information. ACBS reserves the right to update this policy without prior notice.

ContextualScience.org uses any information voluntarily provided by our users to promote an open scientific community and to encourage the contribution and sharing of relevant knowledge, content, and resources. This information is not used for any commercial purposes. ContextualScience.org also tracks user traffic patterns through our site. For visitors, this data is de-identified. For registered users of the site, this data (including number of site contributions and comments posted, as reported in the "Hall of Fame") may be correlated with individual users. Additional information is collected when users register for the site. The website also uses “cookies” technology to collect and store certain information (see below).

Some information is required to create an account on our website, such as your name, email address, password, and address. We do not require other information to become a member. We may record information relating to your use of the Site, such as the searches you undertake, the pages you view, your browser type, IP address, requested URL, referring URL, and timestamp information. We use this type of information to administer the Site and provide the highest possible level of service to you and our members. We also use this information in the aggregate to perform statistical analyses of use behavior and characteristics in order to measure interest in and use of the various areas of the Site.

We use the information to provide individuals with services that are expected by virtue of being a member of the organization. For example, member usernames and passwords allow access to member only sections of the website. This includes access to videos and other materials, the ability to join Chapters or Special Interest Groups (SIGs), access to the Journal of Contextual Behavioral Science, the ability to receive communications from and post on the listserv, and discounted rates for events. We use your contact information to keep you updated on ACBS events, send you the newsletter, remind you of when your membership is about to lapse, and to respond to queries you may have. We also share your contact information with specific chapters or SIGs that you have explicitly expressed an interest so that they may reach out to you. In addition, we use the information we collect to promote the safety and security of our users and our services. For example, we may use the information to authenticate users, facilitate secure payments, protect against fraud and abuse, respond to a legal request or claim, conduct audits, and enforce our terms and policies. We also collect and hold information to comply with legal or regulatory requirements.

This Site may contain links to third party websites. Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you on our Site. Other sites accessible through our site have their own policies in regard to privacy. We are not responsible for the privacy policies or practices of third parties.

When we disclose personal information

Your username and any additional information you voluntarily provide about yourself during the registration process will be publicly available to all registered users of the site on the Membership Directory page. Your email address will not be publicly available, but you will have the option to allow visitors and users of the site to contact you via a web-based form that does not reveal your email address. Your email address or other personal information will never be sold or released to any third parties, including advertisers, sponsors, or partners. ACBS is the owner of this site. ACBS, the ACBS Foundation, or its chapters may email you about the association and professional matters relevant to it, but will not use your personal information for any commercial purposes separate from the organization. Members who opt out of receiving bulk email from ACBS will, by necessity, be removed from any previously nominated interest in any ACBS Chapters or SIGs in order to fulfill your request not to receive emails from ACBS or her components. At times we may be required by law or legal process to disclose your personal information. We may also disclose information about you if we believe that disclosure is necessary for the public interest.

If you post a page or comment on ContextualScience.org your account username will be visible on that page or comment for the general public. If you post content to a ContextualScience.org mailing listserv, your username and message will be visible to ContextualScience.org members on the website, and your username and email address may be visible to others receiving the mailing listserv message.

ACBS's journal (Journal of Contextual Behavioral Science (JCBS)) publisher may be granted access to ACBS membership information (limited to names and contact information) to be used for Journal subscription fulfillment and author recruitment.

You acknowledge that we may, in our sole discretion, preserve your information, share your information with trusted third parties who assist us in operating our website, conducting our business and servicing our members and visitors, and if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: comply with legal process; enforce the terms of use; respond to claims that any content violates the rights to third parties; protect the rights, property or personal safety of ACBS, its users or the general public. These trusted third parties agree to keep this information confidential.

Access to your personal information

You always have access to the information we have about you. To review and update your personal contact information at any time, simply click on the "my account" link on the upper right side of the screen, when logged in. ContextualScience.org does not store credit card information. You may place a request for the information that we have about you using this form or email us via the “Contact Us” link at the top of the screen and tell us that you would like your information modified or entire account and history removed from ContextualScience.org.

Deletion of your personal information

You have the right to have your information and accounts erased from ContextualScience.org. To have your information completely removed from ContextualScience.org you may use this form or email us via the “Contact Us” link at the top of the screen and tell us that you would like your entire account and history removed from ContextualScience.org.

Security

We maintain security measures to protect your personal information from unauthorized access, misuse, or disclosure. However, no exchange of data over the Internet can be guaranteed as 100% secure. While we make every effort to protect your personal information shared with us through our Site, you acknowledge that the personal information you voluntarily share with us through this Site could be accessed or tampered with by a third party. You agree that we are not responsible for any intercepted information shared through our Site without our knowledge or permission.
